What Rights?\">wrote<\/a> back in November, there&#8217;s a battle going on in the world of eBook publishing. The topic then was Amazon using <a href=\"http:\/\/authorsguild.org\/advocacy\/articles\/contracts-on-fire-amazons-lending-library.html\" title=\"Authors Guild on Amazon Prime\">wholesale pricing<\/a> as a benchmark for author royalties as it promotes its Prime Program (and juices sales of the Kindle Fire). The upshot for content creators: You probably want to review your publisher contract and make sure you are fairly compensated (as a percentage of the <em>retail<\/em> price, not wholesale).<br \/>\nThe battle itself, however, is being fought on multiple fronts. In August 2011, the Hagens Berman firm filed a <a href=\"http:\/\/www.hbsslaw.com\/cases-and-investigations\/ebooks\" title=\"Hagens Berman\">class-action suit<\/a> claiming Apple and five top U.S. publishers &#8220;<a href=\"http:\/\/www.hbsslaw.com\/file.php?id=761&#038;key=ecdb5cfd51c029dd03eab73f6ccdd096\" title=\"Hagen Berman complaint\">illegally fixed prices<\/a> of electronic books, also known as e-books.&#8221; They are demanding a jury trial, always a sign that they want the most generous settlement possible.<br \/>\nThe basis of the Hagen Berman complaint is the claim that the five publishing houses &#8220;forced Amazon to abandon its discount pricing and adhere to a new agency model, in which publishers set prices. This would prevent retailers such as Amazon from offering lower prices on e-books.&#8221;<\/p>\n<blockquote><p>If Amazon defied the publishers and tried to sell e-books below the publisher-set levels, the publishers would simply deny Amazon access to the title, <a href=\"http:\/\/www.hbsslaw.com\/cases-and-investigations\/ebooks\" title=\"Complaint\">the complaint details<\/a>. The defendant publishers control 85 percent of the most popular fiction and non-fiction titles.<\/p><\/blockquote>\n<p>The publishers, the complaint goes on, feared Amazon&#8217;s pro-consumer pricing, especially as it threatened the established brick-and-mortar model.<br \/>\nNow it appears that the European Union&#8217;s <a href=\"http:\/\/europa.eu\/rapid\/pressReleasesAction.do?reference=IP\/11\/1509&#038;format=HTML&#038;aged=0&#038;language=EN&#038;guiLanguage=en\" title=\"EU antitrust commission opens e-books investigation\">antitrust<\/a> <a href=\"http:\/\/www.latimes.com\/business\/la-fi-apple-ebook-probe-20111206,0,5432623.story\" title=\"E.U. in antitrust probe of Apple, e-book publishers\">commission<\/a> wants a piece of the action. The E.U. investigation will look into charges that &#8220;international publishers&#8230; have, possibly with the help of Apple, engaged in anti-competitive practices affecting the sale of e-books in the European Economic Area (EEA), in breach of EU antitrust rules.&#8221;<br \/>\nAs <a href=\"http:\/\/tech.fortune.cnn.com\/author\/philiped\/\" title=\"Philip Elmer-Dewitt\">Philip Elmer-Dewitt<\/a> notes in this <a href=\"http:\/\/tech.fortune.cnn.com\/2011\/12\/06\/why-europes-trustbusters-targeted-apples-e-book-cartel\/\" title=\"Why Europe's trustbusters targeted Apple's e-book 'cartel'\">Fortune piece<\/a>, the E.U. appears dead serious. &#8220;In preparation for the formal proceedings announced Tuesday the commission raided the offices of some or all of the five publishers named in the probe.&#8221; [Actually, the <a href=\"http:\/\/europa.eu\/rapid\/pressReleasesAction.do?reference=IP\/11\/1509&#038;format=HTML&#038;aged=0&#038;language=EN&#038;guiLanguage=en\" title=\"E.U. Antitrust investigation of e-books\">E.U. press release<\/a> calls them &#8220;unannounced inspections.&#8221; Ah, so diplomatic.]<br \/>\nIn case that isn&#8217;t interesting enough, back in August 2010, Connecticut Attorney General Richard Blumenthal also investigated potential <a href=\"http:\/\/www.ct.gov\/ag\/cwp\/view.asp?Q=463892&#038;A=3869\" title=\"Connecticut AG investigates e-book deals\">anti-competitive e-book practices<\/a>. The A.G.&#8217;s complaint?<\/p>\n<blockquote><p>Attorney General Richard Blumenthal is investigating agreements between the country\u2019s largest e-book publishers and two of the largest sellers &#8212; Amazon.com, Inc. and Apple, Inc. &#8212; that may block competitors from offering cheaper e-book prices.<\/p><\/blockquote>\n<p>WTF? Who&#8217;s colluding with whom?<br \/>\n<strong>Takeaways<\/strong><br \/>\n(Hey, I&#8217;m no lawyer, but I am an interested party. At least I think I am):<\/p>\n<ul>\n<li>If you are a content creator, an Amazon win here means get ready for wholesale to be the new retail.<\/li>\n<li>If you are a consumer, an Amazon win means e-books will fly off the shelves at giveaway prices, as Amazon juices its Kindle sales.<\/li>\n<li>If you are a publisher, an Amazon win means they are one step closer to moving into the publishing business. As Philip Elmer-Dewitt notes, Amazon is the <a href=\"http:\/\/tech.fortune.cnn.com\/2011\/12\/06\/why-europes-trustbusters-targeted-apples-e-book-cartel\/\" title=\"Amazon 500-lbs gorilla\">500-lbs gorilla<\/a> in the e-book biz.<\/li>\n<\/ul>\n<p>And who knows, at the moment, Amazon may need all the help it can get. There&#8217;s already speculation that as many as a half-million Kindle Fires will be <a href=\"http:\/\/tech.fortune.cnn.com\/2011\/12\/03\/how-many-kindle-fires-are-being-returned-to-amazon\/\" title=\"How many Kindle Fires are being returned?\">returned post-holiday<\/a> (via Philip Elmer-Dewitt). Usability guru Jakob Nielsen, meanwhile, is <a href=\"http:\/\/www.useit.com\/alertbox\/kindle-fire-usability.html\" title=\"Jakob Nielsen on Kindle Fire\">reporting that<\/a> &#8220;Amazon.com&#8217;s new Kindle Fire offers a disappointingly poor user experience.&#8221; It gets worse&#8230; Over the Black Friday sales season, iPad and iPhone were dominant [<a href=\"http:\/\/tech.fortune.cnn.com\/2011\/12\/05\/chart-of-the-day-ipad-iphone-dominate-couch-commerce\/\" title=\"Philip Elmer-Dewitt Chart of the Day\">Chart of the Day<\/a>].<br \/>\nEven 500-lbs gorillas deserve some good news now and then&#8230;<\/p>\n","protected":false},"excerpt":{"rendered":"<p>As we wrote back in November, there&#8217;s a battle going on in the world of eBook publishing.
