I\u2019m thinking of a comment someone made about an early version of my book, \u201cWhat Happened In Craig.\u201d The comment? \u201cThe trial was boring.\u201d The issue was, there were\u00a0<em>two<\/em>\u00a0trials in that book.\u00a0Ah, I said, wait til we get into the craziness of this case&#8230;\u00a0<\/p>\n<p><!-- \/wp:paragraph --><\/p>\n<p><!-- wp:paragraph --><\/p>\n<p>Unfortunately, in this episode I\u2019m about to go there again. Because wouldn\u2019t you know it\u2026 for all the horror of Muriel Pfeil\u2019s stunning homicide, the first place to see any \u201caction\u201d related to her murder was\u2026 an affidavit filed in the court by Neil Sutherland Mackay on October 7, 1976, seeking to modify his custody and visitation rights.<\/p>\n<p><!-- \/wp:paragraph --><\/p>\n<p><!-- wp:heading {\"level\":3} --><\/p>\n<h3 id=\"h-one-court-at-a-time\" class=\"wp-block-heading\">One Court At A Time<\/h3>\n<p><!-- \/wp:heading --><\/p>\n<p><!-- wp:paragraph --><\/p>\n<p>The affidavit was all about Neil\u00a0<em>Pfeil<\/em>\u00a0Mackay. Also known as\u2026 Scotty. His son. Carrying his wife&#8217;s maiden name smack in the middle. By October 14, 1976, the case of <em>Muriel Adele Mackay, Plaintiff versus Neil S. Mackay, Defendant<\/em>, had been assigned. Given to Judge Allen T. Compton. Seems mundane and strange all at once. After all, everyone knows Muriel is dead. But remember: child custody is never far from the forefront here.\u00a0And Compton is ready for this one. In fact, he&#8217;s the most recent judge. One of several assigned to the mess that Neil and Muriel called their &#8220;divorce.&#8221;<\/p>\n<p><!-- \/wp:paragraph --><\/p>\n<p><!-- wp:heading {\"level\":3} --><\/p>\n<h3 id=\"h-mixed-mercy\" class=\"wp-block-heading\">Mixed Mercy<\/h3>\n<p><!-- \/wp:heading --><\/p>\n<p><!-- wp:image {\"sizeSlug\":\"large\"} --><\/p>\n<figure class=\"wp-block-image size-large\"><img decoding=\"async\" class=\"alignleft\" src=\"https:\/\/lelandhale.com\/images\/Compton-2819-1.jpg\" alt=\"\" \/>\n<figcaption class=\"wp-element-caption\"><em><strong>Judge Allen Compton<\/strong><\/em><\/figcaption>\n<\/figure>\n<p><!-- \/wp:image --><\/p>\n<p><!-- wp:paragraph --><\/p>\n<p style=\"text-align: left;\">In an act of judicial courtesy, Judge Compton contacts Neil Mackay. Says he\u2019s been assigned to his case. Or, actually, cases plural. As part of that Judge Compton told Mackay he was going to appoint a\u00a0<em>guardian ad litem<\/em>\u00a0for Scotty.\u00a0Mackay moves to preempt him &#8212; his earlier rulings hadn&#8217;t made Neil particularly happy and the idea of a <em>guardian ad litem<\/em> is something Mackay finds distinctly unappealing &#8212; but Compton, feeling he still has jurisdiction in at least one matter before him, writes a favorable ruling anyway:<\/p>\n<p><!-- \/wp:paragraph --><\/p>\n<p><!-- wp:quote --><\/p>\n<blockquote class=\"wp-block-quote\">\n<p><!-- wp:paragraph --><\/p>\n<p>\u00a0<\/p>\n<p>\u201c\u2026the weight of authority in other jurisdictions clearly favors the proposition that when a custodial parent dies, the right to custody automatically inures, accrues or reverts to the surviving parent.&#8221;\u00a0<\/p>\n<p><!-- \/wp:paragraph --><\/p>\n<\/blockquote>\n<p><!-- \/wp:quote --><\/p>\n<p><!-- wp:paragraph --><\/p>\n<p>Of course, Compton&#8217;s a judge, so he qualifies his ruling. Puts some boundaries around it. Some <em>exceptions<\/em>.<\/p>\n<p><!-- \/wp:paragraph --><\/p>\n<p><!-- wp:quote --><\/p>\n<blockquote class=\"wp-block-quote\">\n<p><!-- wp:paragraph --><\/p>\n<p>It would thus appear clear that\u00a0<em>unless<\/em>\u00a0the surviving non-custodial parent has either been determined to be an unfit parent, or deprived of parental rights, through other court proceedings, or is under a legal disability, that parent is entitled to restoration of parental rights and custody upon the death of the custodial parent.<\/p>\n<p><!-- \/wp:paragraph --><\/p>\n<p><!-- wp:paragraph --><\/p>\n<p>Judge Allen T. Compton<\/p>\n<p><!-- \/wp:paragraph --><\/p>\n<\/blockquote>\n<p><!-- \/wp:quote --><\/p>\n<p><!-- wp:paragraph --><\/p>\n<p>But, at the end of the day, Compton helped engineer a new ruling. One that said Mackay was entitled to custody of Scotty &#8220;for the time being.&#8221; Whatever that meant. Here&#8217;s Mackay himself, quoting Compton&#8217;s letter: <em>\u201cI received a copy of the document from Judge Compton stating I have full care and custody of Scotty. I have a certified copy of that document.\u201d<\/em><\/p>\n<p><!-- \/wp:paragraph --><\/p>\n<p><!-- wp:heading {\"level\":3} --><\/p>\n<h3 id=\"h-a-problem-dead-ahead\" class=\"wp-block-heading\">A Problem Dead Ahead<\/h3>\n<p><!-- \/wp:heading --><\/p>\n<p><!-- wp:paragraph --><\/p>\n<p>If Neil Mackay thought everyone else was just going to lay down and take it, he was wrong. And, in fact, by preempting Compton, he likely bought himself more trouble than he counted on. Roll the dice, take your chances, I guess. His new judge was Roy Madsen, from Kodiak, Alaska. Court is in session.<\/p>\n<p><!-- \/wp:paragraph --><\/p>\n<p><!-- wp:image {\"width\":\"499px\",\"height\":\"auto\",\"sizeSlug\":\"large\",\"align\":\"center\"} --><\/p>\n<figure class=\"wp-block-image aligncenter size-large is-resized\"><img decoding=\"async\" style=\"width: 499px; height: auto;\" src=\"https:\/\/lelandhale.com\/images\/kodiak-bear-madsen-left-2_1.jpg\" alt=\"court\" \/>\n<figcaption class=\"wp-element-caption\"><em><strong>Judge Roy Madsen (left) with 11-ft bear<\/strong><\/em><br \/>His sister and brother (right)<\/figcaption>\n<\/figure>\n<p><!-- \/wp:image --><\/p>\n<p><!-- wp:heading {\"level\":3} --><\/p>\n<h3 id=\"h-in-madsen-s-court\" class=\"wp-block-heading\">In Madsen&#8217;s Court<\/h3>\n<p><!-- \/wp:heading --><\/p>\n<p><!-- wp:paragraph {\"dropCap\":true} --><\/p>\n<p class=\"has-drop-cap\">The pick of Madsen seemed a stroke of genius. His point of reference began far from Anchorage. He was born in a village on Kodiak Island, the biggest island in the United States. His father was a Danish fur trader who owned a general store. His mother was an Alaska Native. They practiced a subsistence lifestyle, working fish traps and supplementing that with wild game. Oh, and hunting expeditions at the service of rich East Coast big game hunters. A man grounded in real life, he would bring that to the courtroom.<\/p>\n<p><!-- \/wp:paragraph --><\/p>\n<p><!-- wp:paragraph --><\/p>\n<p>Judge Madsen\u2019s sense that this was no ordinary case hit him almost immediately.<\/p>\n<p><!-- \/wp:paragraph --><\/p>\n<p><!-- wp:paragraph --><\/p>\n<p>Anchorage authorities offered him a police escort to the Anchorage hearings. And he was told that nobody was to know where he stayed when he was in town. The Muriel Pfeil bombing loomed in the background, a warning to anyone who came near.
